Terms and Conditions

These Terms and Conditions explain how Get Delish Limited supplies its products to customers.
Please read them carefully before placing an order.

1. About Delish

Delish is operated by Get Delish Limited, a company registered in England and Wales.

Company number: 11596290
VAT registration number: 531647592
Website: www.getdelish.co.uk
Email: hello@getdelish.co.uk

In these terms, “Delish”, “we”, “us” and “our” refer to Get Delish Limited.

2. When These Terms Apply

These terms apply to individual customers ordering directly from Delish through our website or another agreed ordering channel.

Separate written terms may apply to wholesale, gym, workplace or other business accounts where agreed.

Our Privacy Policy and Cookie Policy also apply when you use our website.

3. Our Products

Delish provides freshly prepared meals, breakfasts and snacks.

Product photographs are provided as a guide. Because our products are prepared and portioned in small batches, their appearance, presentation and exact weight may vary slightly.

Menus, recipes and product availability may change. Any changes will not affect an order that has already been accepted unless we contact you and agree an alternative.

4. Placing an Order

Please check your order, delivery details and contact information carefully before completing checkout.

After placing an order, you will receive an automated acknowledgement or order email. This confirms that we have received your order but does not necessarily mean that it has been accepted.

Your order is accepted when we confirm that it can be fulfilled.

We may be unable to accept an order if:

  • A product is unavailable;
  • Payment has not been received;
  • The delivery address is outside our agreed area;
  • Incorrect information has been supplied;
  • We identify an error in the price or product description; or
  • We reasonably suspect fraudulent or improper activity.
  • You have ordered previously and have outstanding payment or did not follow our agreed terms.

If we cannot accept an order after payment has been received, we will contact you and refund the amount paid for the unavailable order or item.

5. Availability and Substitutions

All products are subject to availability.

If a selected item or ingredient becomes unavailable, we will contact you before making a material substitution. Depending on your preference and availability, we may:

  • Offer a suitable alternative;
  • Remove the affected item and refund it; or
  • Cancel and refund the affected part of the order.

6. Prices and Payment

All prices are displayed in pounds sterling and include any applicable VAT.

Delivery charges are calculated separately according to your location and will be shown during checkout.

Payment can be made by:

  • PayPal; or
  • Bank transfer.

Bank transfer payments should normally be received before the relevant order cut off unless we have agreed otherwise with you. An order may remain on hold until payment has been received.

Please use your order number as the bank transfer reference so we can identify your payment.

We may change our prices at any time. Any price change will not affect an order that has already been accepted.

7. The £65 Plan

The Delish £65 Plan includes:

  • Five main meals;
  • Five overnight oats; and
  • Five snacks.

Customers can choose Low Carb, Balanced or Bulking main meals.

The plan includes up to two Premium main meals at no additional cost. Further Premium main meals are charged at an additional £1.50 each.

Overnight oats are included as the standard breakfast option. Premium breakfast choices can be added for an additional £1 each.

Delivery is charged separately according to location.

The £65 Plan does not create a subscription or automatic recurring order.

Prices are subject to change.

8. Delivery Areas

Our regular delivery area covers:

  • Cardiff;
  • Penarth;
  • Barry;
  • Sully; and
  • Dinas Powys.

If your address is outside this area, contact us before ordering. We may be able to accommodate other locations, but this is not guaranteed.

Delivery charges are based on location and will be confirmed during checkout.

9. Delivery Days and Order Cut Offs

Our regular delivery days are Sunday and Wednesday.

For Sunday delivery, orders must be placed by 10pm on Thursday.

For Wednesday delivery, orders must be placed by 10pm on Sunday.

Orders placed after a cut off will normally move to the next available delivery date unless you have contacted us.

Orders covering three days will be delivered together. Orders covering five, six or seven days will be divided between the next two scheduled delivery days to help keep the food fresh.

10. Delivery Times

Deliveries normally take place between 10:30am and 2:30pm.

We will email your allocated delivery slot approximately 24–48 hours before each delivery.

Delivery times are estimates. Occasionally, traffic, weather, vehicle problems or other circumstances outside our reasonable control may cause a delay. If a significant delay occurs, we will contact you as soon as reasonably possible.

These can be subject to change.

11. Receiving Your Delivery

You are responsible for providing a complete and accurate delivery address, postcode and contact details.

Please make sure somebody is available to receive the order or provide suitable safe place instructions before delivery.

If nobody is available and no instructions have been provided, we may:

  • Attempt to contact you;
  • Leave the order outside the property; or
  • Leave it in the safest suitable location reasonably available.

We may send confirmation or a photograph showing where the order has been left.

Because our products are perishable, we cannot take an unsuccessful delivery back to our kitchen or attempt another delivery.

Once your order has been delivered, you are responsible for arranging its prompt collection and refrigeration. This does not affect your statutory rights if we have delivered to the wrong address.

12. Storing and Reheating Your Meals

Meals must be refrigerated upon delivery and kept at 5°C or below.

Meals should be consumed within three days of each delivery.

Although our meals taste best fresh, they can be frozen on the day of delivery and stored frozen for up to one month.

Frozen meals must be fully defrosted in the refrigerator before reheating. Do not refreeze a meal after it has been defrosted.

When reheating:

  • Remove the lid;
  • Remove any cold sides or sauce pots;
  • Heat from chilled for approximately 3–4 minutes, stirring halfway where possible;
  • Allow the meal to stand for one minute;
  • Make sure it is steaming hot throughout; and
  • Reheat once only.

Heating times may vary depending on the appliance used.

If meals have not been collected, refrigerated, frozen or reheated in accordance with these instructions, we cannot guarantee their quality or safety.

13. Ingredients, Allergens and Dietary Requirements

Ingredient, allergen and nutritional information is provided for each individual meal through our website.

Please check this information before placing an order and again before eating, as ingredients and recipes may vary between products.

Our food is prepared in a kitchen that handles multiple allergens. Although we take allergen management seriously, we cannot guarantee a completely allergen free preparation environment.

If you have an allergy, intolerance, coeliac disease or another medical dietary requirement, contact us before ordering so we can discuss whether your selected meals can be safely accommodated.

A checkout note alone is not sufficient notification of an allergy or intolerance.

Some dishes may be made without gluten containing ingredients, but this does not necessarily mean that they are suitable for somebody with coeliac disease or a severe gluten allergy.

Our butcher supplies Halal meat. However, our kitchen also handles non Halal ingredients, including pork, and Delish is not a Halal certified kitchen. Contact us before ordering if you require more information about a particular meal.

14. Nutritional Information

We calculate nutritional information using the recipes, ingredient information and portion sizes used to prepare our products.

We take reasonable care to make this information as accurate as possible. However, nutritional values may vary slightly because of natural ingredient differences, supplier changes and normal small batch preparation.

Calorie ranges shown for Low Carb, Balanced and Bulking plans are averages rather than guarantees for every meal.

Our products and nutritional information are not medical advice or a substitute for advice from a qualified healthcare professional.

15. Changing or Cancelling an Order

You may request a change or cancellation before the relevant order cut off:

  • 10pm Thursday for Sunday delivery; or
  • 10pm Sunday for Wednesday delivery.

To request a change or cancellation, contact us by email and include your order number.

Once the relevant cut off has passed, ingredients will have been ordered and preparation may have started. Orders cannot be changed or cancelled after this point.

Our products are perishable and liable to deteriorate or expire rapidly. The normal 14 day change of mind cancellation right for many online purchases does not apply to these products.

This does not affect your legal rights if a product is faulty, unsafe, not as described or otherwise does not meet the requirements of consumer law.

If we cancel an order or cannot supply an item you have paid for, we will offer an alternative or refund the relevant amount.

16a. Problems With an Order

Please check your order promptly after delivery.

If an item is:

  • Missing;
  • Incorrect;
  • Damaged;
  • Unsafe;
  • Not as described; or
  • Otherwise unfit for consumption,

Contact us by email within 24 hours of delivery wherever reasonably possible.

Please provide:

  • Your order number;
  • A description of the problem; and
  • Clear photographs of the product and packaging.

Do not consume anything that you reasonably believe may be unsafe.

We will investigate the issue and provide the remedy required by law. Depending on the circumstances and your preference, this may include an appropriate replacement, refund or another agreed resolution.

Nothing in these terms limits your statutory rights.

16b. Meals Purchased Through Gyms and Other Stockists

Delish may supply meals to selected gyms, workplaces and other approved third-party stockists for resale.

Responsibilities of the Gym or Stockist

Once an order has been delivered to and accepted by a gym or stockist, that business is responsible for the correct storage, handling, display and sale of the products.

The gym or stockist must:

  • Refrigerate all meals promptly and keep them continuously at 5°C or below;
  • Monitor and maintain appropriate refrigerator temperatures;
  • Follow suitable stock rotation procedures;
  • Keep all product labels, ingredient information, allergen information and use by dates visible and intact;
  • Remove and safely discard any product once its use by date has passed;
  • Remove any product that has been damaged, incorrectly stored or may otherwise be unsafe;
  • Never sell, supply or offer a product after its use by date;
  • Not alter, relabel or repackage a product without Delish’s written permission; and comply with all applicable food safety, food hygiene and retail requirements.

The gym or stockist must notify Delish promptly if any products arrive damaged, at an unsuitable temperature or otherwise appear unfit for sale.

Delish is not responsible for deterioration, loss or a food safety issue caused after correct delivery by the gym or stockist’s failure to store, handle, rotate or sell the products correctly.

Customers Purchasing From a Gym or Stockist

If you purchase a Delish product from a gym, workplace or another third party stockist, your contract of sale is with that business rather than directly with Get Delish Limited.

The gym or stockist is responsible for:

  • Taking your payment;
  • Issuing proof of purchase;
  • Storing and displaying the product correctly;
  • Making sure products are not sold after their use by date; and
  • Handling questions, complaints, refunds and other rights arising from that retail transaction.

If you experience a problem with a product purchased from a gym or stockist, contact the business from which you purchased it in the first instance. Keep the product, packaging and proof of purchase, and provide photographs where possible.

Do not consume any product that is past its use by date, appears damaged, has not been kept chilled or that you reasonably believe may be unsafe.

This section does not affect your statutory rights as a consumer.

17. When Refunds May Not Be Available

Subject to your statutory rights, we may be unable to provide a refund where:

  • You change your mind after the order cut off;
  • Incorrect delivery information was provided;
  • Nobody was available to receive the delivery and no suitable instructions were supplied;
  • The order was not collected or refrigerated promptly after delivery;
  • The food was stored, frozen, defrosted or reheated incorrectly;
  • You simply dislike a meal that was supplied correctly and as described; or
  • The issue was caused after the order had been correctly delivered.

We will consider each reported problem fairly and individually.

18. Promotions, Discounts and Gift Cards

Promotions, discount codes and special offers may be subject to additional terms displayed when the offer is made.

Unless stated otherwise:

  • Discount codes cannot be exchanged for cash;
  • Only one discount code may be used per order;
  • Codes must be applied before completing checkout; and
  • Offers may be withdrawn or changed before an order is accepted.
  • Personal discount codes cannot be shared with or used by anyone other than yourself.

Student discounts require valid proof of eligibility.

Gift card validity, expiry and redemption terms will be displayed when the gift card is purchased. Gift cards cannot be exchanged for cash except where required by law.

19. Website Accounts

If you create an account, you are responsible for:

  • Keeping your login details secure;
  • Providing accurate information; and
  • Informing us if you believe somebody has accessed your account without permission.

We may suspend or close an account where we reasonably believe it is being used fraudulently, unlawfully or in breach of these terms.

20. Website Content and Intellectual Property

The Delish name, logo, website content, photographs, recipes, designs and other branded materials belong to Get Delish Limited or are used with permission.

They must not be copied, reproduced, sold or used commercially without our written permission.

We try to keep our website accurate and available. However, we cannot guarantee that it will always be uninterrupted or free from technical errors.

21. Privacy

We process personal information in accordance with our Privacy Policy.

Our Cookie Policy explains how cookies and similar technologies are used on our website.

By placing an order, you confirm that the information you provide is accurate and that we may use it to process payment, prepare your order, arrange delivery and communicate with you about that order.

22. Our Responsibility to You

We are responsible for losses that are a foreseeable result of our breaching these terms or failing to use reasonable care and skill.

We do not exclude or limit liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation; or
  • A breach of your statutory consumer rights.

Our products are supplied for personal use. We are not responsible for business losses such as lost profits, lost revenue or loss of business opportunity arising from a consumer order.

23. Events Outside Our Control

We are not responsible for delays or failure to perform our obligations where this is caused by circumstances outside our reasonable control.

These may include severe weather, road closures, vehicle breakdowns, supplier disruption, utility failures, public health restrictions or other emergencies.

We will contact affected customers as soon as reasonably possible and take reasonable steps to minimise disruption.

24. Changes to These Terms

We may update these terms to reflect changes in our service, operations or legal obligations.

The terms applying to your order will be those available when your order is placed.

The date at the top of this page shows when the terms were last updated.

25. If Part of These Terms Is Invalid

If any part of these terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

A delay in enforcing any part of these terms does not mean that we have waived our right to enforce it later.

26. Third Party Rights

These terms are between you and Get Delish Limited. No other person has the right to enforce them unless the law says otherwise.

27. Governing Law

These terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising from these terms, subject to any rights you may have as a consumer to bring proceedings elsewhere.
